1. Agreement to these terms
These Terms of Use (the “Terms”) are a binding agreement between you and The Big Fat Dad LLC, a Delawarelimited liability company (“TrustMatch,” “we,” “us”), governing your use of the TrustMatch websites, apps, and API (together, the “Service”).
By creating an account, running a TrustCheck, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” means that organization.
2. Eligibility
You must be at least 18 years old and legally able to enter into a contract to use the Service. You may not use the Service if we have previously terminated your account, or if you are barred from doing so under the laws of the United States or your jurisdiction.
3. What the Service is — and what it is not
TrustMatch verifies identity signals. Given a name plus a phone number, email address, or postal address, we check whether those details tie back to a real, consistent identity and return a 0–100 TrustScore, a verdict, and human-readable reasons.
TrustMatch is not a consumer reporting agency. A TrustCheck is not a consumer report or an investigative consumer report under the Fair Credit Reporting Act (FCRA), 15 U.S.C. §1681 et seq., or any equivalent state law. We do not provide criminal records, credit history, employment history, rental history, or education records, and we do not evaluate character or general reputation.
A TrustCheck tells you whether identity details are consistent. It does not tell you whether a person is safe, honest, or trustworthy. It is one input to your own judgment — never a substitute for it.
4. Prohibited uses
You may not use the Service, in whole or in part, as a factor in establishing a person's eligibility for any of the following:
- employment, promotion, reassignment, or retention;
- housing, tenancy, or rental decisions;
- credit, lending, or financial services;
- insurance underwriting or pricing;
- educational admissions, professional licensing, or government benefits;
- any other purpose regulated by the FCRA or an equivalent state law.
You also may not use the Service to:
- stalk, harass, threaten, intimidate, dox, or harm any person, or to locate someone who has taken steps to avoid being found, including a person protected by a restraining or protective order;
- violate any law or regulation, including the Driver's Privacy Protection Act, the Gramm-Leach-Bliley Act, the Telephone Consumer Protection Act, or any anti-discrimination law;
- scrape, resell, sublicense, redistribute, or build a competing database from results, or otherwise systematically extract data from the Service;
- circumvent quotas or rate limits, share or resell API keys, or create multiple accounts to obtain additional free checks;
- reverse engineer, decompile, or attempt to derive the source code or underlying data sources of the Service;
- introduce malware, probe or test the vulnerability of our systems without our written permission, or interfere with the integrity or performance of the Service.
We may suspend or terminate your account immediately, without refund, for any violation of this section. We may also report violations to law enforcement.
5. Your account and API keys
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us at trust@trustmatch.app immediately if you suspect unauthorized use.
API keys are shown exactly once at creation. We store only a SHA-256 hash and cannot recover a key for you. Treat a key like a password: never embed it in client-side code, a mobile app binary, or a public repository. You are responsible for all usage and charges incurred under your keys, including usage resulting from a key you exposed.
6. Plans, quotas, and billing
The Service is offered on free and paid plans, plus prepaid check packs. Current pricing is at /pricing. Payments are processed by Stripe; by subscribing you also agree to Stripe's terms.
- Subscriptions renew automatically at the end of each billing cycle at the then-current rate, until you cancel.
- Quotas are enforced per billing cycle. Unused checks do not roll over unless the plan says so.
- Overage, where a plan permits it, is metered and billed in arrears at the rate published at the time of use.
- Taxes are your responsibility where applicable.
- Failed payments. If a charge fails, we may retry it and may suspend or downgrade your account until it is resolved.
- Price changes.We may change pricing with at least 30 days' notice by email. Changes take effect at your next renewal, and you may cancel before then.
Cancellation. You may cancel at any time from your account settings. Cancellation stops future renewals; your plan remains active through the end of the cycle you have already paid for.
7. No refunds on digital goods
All fees are non-refundable. Subscription payments, check packs, and overage charges are for digital goods delivered immediately on purchase, and all sales are final.
This includes, without limitation, partial billing cycles, unused checks remaining at cancellation, checks consumed on results you were not satisfied with, and periods during which you did not use the Service.
A TrustCheck consumes a check when it runs, whatever the result. A low score, an inconclusive verdict, or a “no record found” outcome is a delivered result, not a failed one — the search was performed and the answer returned.
We may, at our sole discretion, issue a credit or refund in individual cases — for example a duplicate charge or a documented service failure on our side. Doing so once does not obligate us to do so again, and does not waive this section.
If you believe you were charged in error, email trust@trustmatch.app within 30 days of the charge and we will investigate. Contact us before disputing a charge with your bank or card issuer. We may suspend an account with an open chargeback until it is resolved.
8. Communications and email consent
By creating an account, you consent to receive email from us at the address on your account. This falls into two categories:
- Transactional and service email — receipts, invoices, password resets, security alerts, quota warnings, and notices of changes to these Terms or the Privacy Policy. You cannot opt out of these while your account is open; they are part of the Service. To stop them, close your account.
- Product and marketing email — product updates, new features, tips, research, and offers. You can opt out at any time using the unsubscribe link in any such message, or by emailing trust@trustmatch.app with the subject UNSUBSCRIBE. We will process it promptly and in any case within 10 business days, as required by the CAN-SPAM Act.
You agree that electronic communications satisfy any legal requirement that a communication be in writing.
9. Intellectual property
The Service, including its software, design, text, graphics, scoring methodology, and the TrustMatch name and logo, is owned by The Big Fat Dad LLC and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.
Your content. You retain ownership of the information you submit. You grant us a license to use it as needed to provide the Service and as described in the Privacy Policy.
Results. You may use TrustCheck results for your own internal, permitted purposes. You may not republish, resell, or redistribute them, or present them as your own product.
Feedback. If you send us suggestions, we may use them without restriction or compensation.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We depend on third-party data sources. We do not warrant that results are accurate, complete, current, or error-free. A high TrustScore is not a guarantee that a person is safe, legitimate, or who they claim to be, and a low score is not proof of wrongdoing. Identity records can be outdated, incomplete, or wrong.
You are solely responsible for the decisions you make. Always take your own precautions when meeting someone, sending money, or sharing personal information.
We do not warrant that the Service will be uninterrupted, secure, or free of defects, and we may modify, suspend, or discontinue any part of it at any time.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTMATCH AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted, and nothing in these Terms limits liability for fraud, gross negligence, or willful misconduct.
12. Indemnification
You agree to indemnify and hold harmless The Big Fat Dad LLC and its officers, members, and employees from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, your violation of any law or the rights of any third party, or any use of the Service for an FCRA-regulated purpose or any other prohibited use.
13. Termination
You may stop using the Service at any time and delete your account from your account settings.
We may suspend or terminate your access at any time, with or without notice, if you breach these Terms, if we suspect fraud or abuse, if required by law, or if we discontinue the Service. Termination for breach does not entitle you to a refund.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.
Informal resolution first. Before filing any claim, you agree to contact us at trust@trustmatch.app and attempt to resolve the dispute informally for at least 30 days. Most disputes are resolved this way.
If that fails, you and TrustMatch agree that any dispute will be brought exclusively in the state or federal courts located in Delaware, and both parties consent to personal jurisdiction and venue there. This does not prevent either party from seeking injunctive relief in any court of competent jurisdiction to protect its intellectual property, or from bringing an individual claim in small-claims court.
You and TrustMatch agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class or representative action.
15. General
Changes.We may update these Terms. We will revise the “Last updated” date, and for material changes we will give notice by email or through the Service before they take effect. Continuing to use the Service after that means you accept the revised Terms.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and TrustMatch regarding the Service.
Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions stay in force.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither party is liable for a delay or failure caused by events beyond its reasonable control.
